so what happens when a lender gets judgement to forclose and sell on equitable mortagage and a 3rd party claims to have purchased the property

    An Equitable Mortgage does not block the future transfers of the Title. Therefore, Lending institutions should be so prudent when granting a loan against such a Mortgage.
    The best solution to prevent from such an issue is to execute a “Caveat” in the Land Registry of the area concerned.

    (The validity of this mechanism may vary from country to country. Therefore, better to get a Legal opinion from a Lawyer)
