constructive fraud

1. Unintentional deception or misrepresentation.

2. Obtaining of a legal but unconscientious advantage through an unfair transaction, such as in dealings with the ignorant, poor, or weak. Courts may set aside or refuse to enforce an agreement where the terms are such that no person with free volition or proper advice would have agreed to.
