mistrial
Definition
Erroneous, invalid, nugatory trial, so declared and brought to an end by the trial judge without a determination on the merits of the case. Mistrials are caused by fundamental and incurable error in following the due process, serious misconduct during trial, or where a jury cannot unanimously agree on the verdict. The trial must start anew, with the selection of a new jury.
