possessor in bad faith
Definition
One who takes possession of land or other assets as counterparty to a contract, despite having knowledge or awareness that the transaction is not strictly in accordance with all applicable legal restrictions. The law draws distinctions based on good faith or bad faith in an attempt to protect counterparties who are genuinely unaware of relevant legal issues.
