Definition
An official written notification of being fired or laid off from a job position. According to the Fair Labor Standards Act, there are no specific requirements for companies to give an employee notice before they are terminated or placed on layoff status. However, if an employee is terminated while under contract covered by a collective bargaining/union agreement, an employer must give advanced notice through a termination notices. Some states may have specific requirements for employer notification at the time of layoff or termination. Additionally, the WARN Act requires employers who maintain more than 100 employees to provide 60 days advance notice if a plant is to be closing and major layoffs are forthcoming.
