Definition
Under the US law, any act, policy, or practice of a foreign government that (1) violates, is inconsistent with, or otherwise denies benefit to the US under any trade agreement to which the US is a party, (2) is unjustifiable, unreasonable, or discriminatory, and burdens or restricts US commerce, or (3) is inconsistent with a favorable section 301 of GATT (now WTO) determination by the US trade representative.
